1. Insight on Manufacturing Bonded Warehouse Scheme under indian Customs Act

  • Manufacture and Other Operations in Warehouse (no. 2) Regulations, 2019 (MOOWR, 2019)[1] notified by the Central Board of Indirect Taxes and Customs.
  • The key features of the regulations are:

    A person who has been granted a license for a warehouse under section 58 of the Customs Act, or a person who applies for a license for a warehouse along with permission to undertake manufacturing or other operations in the warehouse under section 65, shall be eligible to apply for operating under the regulations.

    The applicant shall provide an undertaking to maintain accounts of receipt and removal of goods, execute bond and inform the input-output norm wherever considered necessary.

    The licensee shall comply with the prescribed conditions for transportation of goods from: customs station to warehouse;one warehouse to another; warehouse to customs station for export; and warehouse for home consumption.

    The licensee shall maintain the relevant records in relation to the warehoused goods for a minimum period of five years from the date of removal of goods.

    The regulations have come into force from 1 October 2019. Further, a circular[2] has been issued in this regard.

    This initiative is aimed at attracting investments in India for manufacturing sector and also to support the Make in India initiative of the Government of India.

    The customs duty deferment on import of capital goods under MOOWR, 2019 is positive for the manufacturing sector as there appears to be no restriction in using the duty-free capital goods in the warehouse for domestic/export clearances. Similar benefit is also available for imported raw materials/packing material, where the payment of proportionate customs duty can be deferred till ex-bond clearance of finished goods in the domestic market.

    While an FAQ has been issued by Invest India on bonded manufacturing, it would be helpful if CBIC clarifies on various open issues such as process to be followed in case of clearance of goods for job work outside the bonded premises, continuation of benefits under the Foreign Trade Policy (FTP) for goods exported from bonded warehouse, benefit of duty deferment in case of conversion of Export Oriented Unit (EOU) into bonded warehouse, guidelines around warehouse keeper etc. This initiative may help in improving capacity utilization as there is no restriction on quantum of clearances that need to be exported or cleared in domestic market. Also, key fiscal benefits of duty-free procurement of capital goods/inputs as enjoyed by an EOU or a Special Economic Zone or under FTP could be availed by opting this scheme. Streamlining the process for approval and provision for single digital account may also facilitate ease of doing business and compliances.
